02 — The service
Lunelle is a management platform for beauty professionals. It provides appointment scheduling, client management, a public booking site, checkout and payment tools, client messaging, and related features. The service is sold as a subscription. Some features depend on third-party providers, described in section 11.
06 — Client-facing processing fees
Lunelle includes an optional setting that adds a processing fee to your clients’ card payments instead of absorbing card costs in your prices. This setting is off by default. Enabling it is your decision, and as the merchant of record you are solely responsible for using it lawfully, including compliance with:
- Card network rules, including surcharge caps, cost-of-acceptance limits, notice requirements, and restrictions on debit and prepaid cards
- Federal, state, and local laws, including states that restrict or prohibit adding card fees and states with price-disclosure requirements
- Signage and disclosure duties at your place of business
Lunelle provides the mechanism, displays the fee to your client before payment, and itemizes it on receipts — but Lunelle does not provide legal advice and does not verify that the setting is lawful for your business or location. If you are unsure, keep the setting off and consult a professional.
07 — Your content & client data
Your business data — client records, photos, appointment history, and everything else you put into Lunelle — belongs to you. You grant Lunelle a limited license to host and process it solely to provide the service. You are responsible for having the rights and consents that data requires, including:
- Your clients’ consent for photos you take and store
- Your clients’ consent to keep a card on file, where you use that feature
- Messaging consent, as described in the SMS Policy
12 — Intellectual property
Lunelle owns the service — the apps, the site, the design, the code, and the Lunelle name and brand. Your subscription gives you a limited, non-exclusive, non-transferable right to use the service for your business while these Terms are in effect. Section 07 governs your own content, which stays yours.
14 — Disclaimer of warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LUNELLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT PAYMENT PROCESSING WILL BE AVAILABLE AT ALL TIMES, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR FREE OF INFRINGING CONTENT.
15 — Limitation of liability
To the maximum extent permitted by law, Lunelle is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Lunelle’s total liability for all claims is limited to the subscription fees you paid us in the 12 months before the claim arose. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
16 — Indemnity
You will indemnify and hold Lunelle harmless from claims, damages, and expenses (including reasonable legal fees) arising from your business and your use of the service — including your client transactions, refunds and disputes, client-facing processing fees you choose to enable, the client data and content you store, your client messaging, and any violation of these Terms or of applicable law.
