Terms of service.

01 — Agreement

These Terms of Service are an agreement between you — the business that creates a Lunelle account — and Lunelle. By creating an account or using the service, you agree to these Terms, to our Privacy Policy, and to our SMS Policy. If you do not agree, do not use the service.

02 — The service

Lunelle is a management platform for beauty professionals. It provides appointment scheduling, client management, a public booking site, checkout and payment tools, client messaging, and related features. The service is sold as a subscription. Some features depend on third-party providers, described in section 11.

03 — Eligibility & your account

You must be at least 18 years old and use Lunelle for business purposes. You are responsible for:

  • Keeping your credentials secure, and telling us about any unauthorized access
  • Providing accurate account and business information
  • The actions of team members you invite to your salon

04 — Subscription, trial & billing

  • Free trial: New accounts can start a free trial without a payment method. When the trial ends without a payment method on file, the subscription ends and paid features lock. Nothing is charged without your action.
  • Billing: Subscriptions are billed through Stripe and renew automatically each period until canceled.
  • Cancellation: You can cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing period.
  • Price changes: We can change subscription prices with advance notice. Changes apply from your next billing period.
  • Refunds: Fees are non-refundable except where the law requires otherwise.

05 — Payment processing with Stripe

Client payments run on Stripe Connect. To accept card payments you must create a Stripe connected account, and the Stripe Connected Account Agreement applies to it. Three points follow from that structure:

  • You are the merchant of record. Charges to your clients are your charges, on your Stripe account. Stripe’s processing fees for those charges are billed to you by Stripe at Stripe’s rates.
  • Lunelle is not a party to your client transactions. Prices, refunds, disputes, chargebacks, and sales taxes for your services are your responsibility. Lunelle is not a bank or a money transmitter.
  • Platform fee: Lunelle may collect a platform fee on card transactions processed through the service. The current fee structure is shown in the app’s payment settings and can change with notice.

06 — Client-facing processing fees

Lunelle includes an optional setting that adds a processing fee to your clients’ card payments instead of absorbing card costs in your prices. This setting is off by default. Enabling it is your decision, and as the merchant of record you are solely responsible for using it lawfully, including compliance with:

  • Card network rules, including surcharge caps, cost-of-acceptance limits, notice requirements, and restrictions on debit and prepaid cards
  • Federal, state, and local laws, including states that restrict or prohibit adding card fees and states with price-disclosure requirements
  • Signage and disclosure duties at your place of business

Lunelle provides the mechanism, displays the fee to your client before payment, and itemizes it on receipts — but Lunelle does not provide legal advice and does not verify that the setting is lawful for your business or location. If you are unsure, keep the setting off and consult a professional.

07 — Your content & client data

Your business data — client records, photos, appointment history, and everything else you put into Lunelle — belongs to you. You grant Lunelle a limited license to host and process it solely to provide the service. You are responsible for having the rights and consents that data requires, including:

  • Your clients’ consent for photos you take and store
  • Your clients’ consent to keep a card on file, where you use that feature
  • Messaging consent, as described in the SMS Policy

08 — Client messaging

Lunelle can send appointment emails and text messages to your clients on your behalf. You must only message clients who have opted in, honor opt-outs, and use messaging only for the transactional purposes the SMS Policy describes. We can suspend messaging for accounts that generate complaints or violate carrier requirements.

09 — AI features

Some features generate images or content with third-party AI models. For those features:

  • Output is produced by probabilistic models and can contain artifacts or inaccuracies — review it before you use or publish it
  • AI-generated images are not photographs of real results; do not present them as real client work
  • You own your use of the output, and you are responsible for it, including third-party rights
  • AI-generated content may not qualify for copyright protection in all jurisdictions

10 — Acceptable use

You agree not to:

  • Use the service for anything illegal, or process payments for businesses or activities Stripe prohibits
  • Upload content that infringes the rights of others
  • Interfere with the service, bypass its limits or security, or access it by automated means
  • Reverse engineer, copy, or resell the service

We can investigate violations and suspend or terminate accounts involved in them.

11 — Third-party services

Parts of the service are delivered by third parties — payment processing by Stripe, text messaging by our SMS carrier partners, AI features by Google’s models, and authentication and hosting infrastructure providers. Their terms apply to their parts of the service, and features that depend on them are available only while those providers make them available to us.

12 — Intellectual property

Lunelle owns the service — the apps, the site, the design, the code, and the Lunelle name and brand. Your subscription gives you a limited, non-exclusive, non-transferable right to use the service for your business while these Terms are in effect. Section 07 governs your own content, which stays yours.

13 — Termination

You can stop using Lunelle and cancel your subscription at any time. We can suspend or terminate accounts that violate these Terms, abuse the payment system, or create legal risk for the platform. On termination, the sections that by their nature survive — including disclaimers, limitation of liability, and indemnity — remain in effect. Account deletion and data handling are described in the Privacy Policy.

14 — Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LUNELLE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT PAYMENT PROCESSING WILL BE AVAILABLE AT ALL TIMES, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR FREE OF INFRINGING CONTENT.

15 — Limitation of liability

To the maximum extent permitted by law, Lunelle is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Lunelle’s total liability for all claims is limited to the subscription fees you paid us in the 12 months before the claim arose. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

16 — Indemnity

You will indemnify and hold Lunelle harmless from claims, damages, and expenses (including reasonable legal fees) arising from your business and your use of the service — including your client transactions, refunds and disputes, client-facing processing fees you choose to enable, the client data and content you store, your client messaging, and any violation of these Terms or of applicable law.

17 — Governing law & disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Disputes will be brought exclusively in the state or federal courts located in Utah, and both parties consent to that venue.

18 — Changes & contact

We can update these Terms from time to time. Material changes will be posted with a new “Last updated” date, and your continued use of the service after changes are posted constitutes acceptance of the revised Terms.
